Failure to conduct a proper psychiatric assessment

Davies and Partners successfully settled a case for a client against Birmingham and Solihull Mental Health NHS Trust.

The client, who had taken an overdose and complained of hearing voices telling him to self-harm, was discharged home from hospital without undergoing a full psychiatric assessment.

Later that night the client harmed himself, as a result of which he suffered severe burns to his face, arms and hands. Court proceedings were issued alleging that if a proper psychiatric assessment had been performed the client would have been diagnosed as suffering with psychosis and he would have been detained and treated under the Mental Health Act.

The client would not have been sent home and he would not have been able to harm himself. Without making any formal admissions, the Trust offered to settle the claim in the sum of £150,000.00 which the client accepted.
