Five Examples of Medical Negligence

Medical negligence occurs when healthcare providers fail to deliver the standard of care that patients rightfully expect, and as a result, harm is caused. Despite the dedication of most professionals, high profile cases in the UK have shown that mistakes whether during diagnosis, treatment, or even in alternative therapy settings can have devastating, life changing, or even fatal consequences. This article looks at five examples of medical negligence in the UK, illustrating the range of failures that can occur and highlighting the importance of patient safety.

Emergency maternity care negligence

A tragic case from St Thomas Hospital in London involves 36-year-old Ayaan Waeys. Ayaan presented with clear warning signs of pre-eclampsia, including high blood pressure, gestational diabetes, and severe swelling. Despite these symptoms, hospital staff failed to arrange a proper review by a senior consultant. After delivering her stillborn baby, Ayaan experienced heavy bleeding that went unnoticed until her condition worsened dramatically, leading to her being placed in a coma and eventually dying. Her family alleges that timely intervention could have saved her life and that discrimination may have contributed to the substandard care she received.

Negligence leading to surgical errors

Surgical errors also represent a serious form of medical negligence, and are classed by the NHS as “never events”, which means there should be sufficient checks and safety guidelines in place to make sure they never happen. In 2023 – 2024 six patients received surgery that was meant for someone else, and three had an organ or bodily structure removed that was not supposed to be. Such errors, whether involving the unintended removal of an organ or limb, or damage to vital tissues, can result in long term complications, additional surgeries, and a significant decrease in quality of life. This case underlines the need for precision and constant vigilance in the operating theatre, where even small oversights can have profound consequences.

Misdiagnosis negligence

Misdiagnosis can be equally devastating. In the well-known case of Gregg v Scott, a doctor erroneously diagnosed a malignant cancer as a benign condition. This misdiagnosis delayed the correct treatment for nine months, reducing the patient’s chance of a ten year survival from 42% to 25%. The legal focus was on whether the negligence had deprived the patient of a genuine chance to recover. Although the court ultimately ruled against awarding damages for the loss of chance, the case highlights the critical importance of accurate diagnosis and prompt treatment in saving lives.

Anaesthetic errors leading to negligence

Another dramatic example is provided by the case of R v Adomako. During an eye operation, a locum anesthetist failed to notice that the oxygen tube had become disconnected from the ventilator. This oversight meant that the patient did not receive oxygen for several minutes, resulting in a period of severe hypoxia that led to extensive brain damage and eventual death six months later. This case is frequently cited as a stark reminder that even seemingly minor errors in an operating theatre can lead to catastrophic outcomes.

Alternative therapy negligence

Medical negligence is not limited to conventional medical settings. In a controversial case involving alternative therapy, an unregulated self-healing therapist was found guilty of gross negligence manslaughter after a 71 year old woman with type 1 diabetes died. During one of his workshops, the woman ceased taking her insulin and fasted, trusting his advice on the therapy. Instead of encouraging her to continue her vital medication or seek medical help, the therapist attributed her worsening condition to a healing crisis. His failure to act appropriately resulted in her fatal decline, underscoring the dangers of unregulated alternative therapies.

These examples demonstrate that medical negligence can occur across a range of scenarios, from emergency maternity care and surgical procedures, to misdiagnosis and even alternative therapeutic settings. They serve as stark reminders that even small oversights or errors can have devastating consequences which can leave families bereaved, or struggling to cope with a loved-one that has sustained life-changing injuries. While most healthcare professionals provide excellent care, these incidents highlight the need for vigilance, continuous improvement, and robust systems of accountability to ensure patient safety.
